Terms of Service
These Terms of Service (“Terms”) govern your use of the PerfectlyAI English tutor application, website, and related services. By downloading, installing, or accessing PerfectlyAI you agree to be bound by these Terms. If you do not agree, do not use the app.
1. Eligibility and Accounts
You must be at least 16 years old (or the age of digital consent in your region) and have authority to bind your organization, if applicable. You are responsible for maintaining accurate account information and for safeguarding your credentials.
2. App License
PerfectlyAI grants you a limited, non-exclusive, non-transferable, revocable license to access and use the tutor and generate learning outputs for lawful personal or organizational education purposes. All proprietary rights in PerfectlyAI remain with us. You may not copy, modify, distribute, sell, or lease any part of the app unless laws prevent these restrictions.
3. Acceptable Use
- Use PerfectlyAI only for lawful learning, practice, and tutoring.
- Do not upload or connect content that is unlawful, harmful, misleading, or that infringes on others' rights.
- Do not attempt to probe, scan, or test system vulnerabilities, circumvent security controls, or bypass usage limits.
- Review AI-generated outputs before relying on them, especially for exams or professional use.
- Respect privacy obligations and obtain necessary permissions before sharing personal data.
4. Subscriptions and Billing
Certain features may require a paid plan. Fees are billed according to the plan selected by you or your organization. Unless stated otherwise, charges are non-refundable except where required by law. Failure to pay can result in suspension or termination of access.
5. Data and Privacy
You own the prompts, recordings, and writing you submit through PerfectlyAI. You grant us a limited license to host, process, and transform that content as needed to operate the tutor and deliver requested features. You are responsible for ensuring you have the rights to provide that content. Our handling of personal data is described in the Privacy Policy.
6. Third-Party Services
PerfectlyAI may integrate with third-party services, data sources, or model providers. Those services are governed by their own terms and privacy policies, and we are not responsible for their actions. Use integrations at your own discretion.
7. Disclaimers
PerfectlyAI is provided “as is” and “as available” without warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose, or non-infringement. AI-generated responses may be probabilistic or incomplete; you are responsible for reviewing outputs before relying on them. We do not guarantee that the app will be uninterrupted or error-free.
8. Limitation of Liability
To the fullest extent permitted by law, PerfectlyAI will not be liable for indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, data, or goodwill arising out of or related to your use of the app. Our total liability for any claim is limited to the amount paid for the service during the 12 months preceding the event giving rise to the claim.
9. Termination
You may stop using PerfectlyAI at any time. We may suspend or terminate your access immediately if we believe you have violated these Terms, failed to pay fees when due, or engaged in activity that creates risk for the service or other users.
10. Changes to the Service or Terms
We may modify or discontinue features at any time. We may update these Terms by posting a revised version with a new “Effective” date. Continued use after changes become effective constitutes acceptance.
11. Governing Law
These Terms are governed by the laws applicable in your place of residence unless a different governing law is required by mandatory consumer protection rules.
